On Wednesday, March 3, 2021, I sent an email update regarding Service Employees International Union’s (SEIU) ongoing efforts to organize our part-time faculty and part-time instructors. Upon our return from break, I was able to engage with several of you in open, town hall conversations about these efforts and many other collegewide matters impacting part-time faculty and part-time instructors. I look forward to more of those opportunities for us to engage directly in the future.
This week, the Public Employees Relations Commission (PERC) issued a decision regarding the outstanding procedural matters that were before the commission for review. Consistent with our demonstrated commitment to transparency in this process, you are receiving this email so that we can provide you with these timely updates.
On Tuesday, March 30, 2021, PERC issued an order finalizing who will be eligible to vote in an election and directing that an election be scheduled. While we do not yet have information pertaining to the specific election timeline, we do have information regarding outstanding legal and procedural matters, including decisions related to the bargaining unit and voter eligibility. Here’s what we know right now:
- While Valencia College believes that the exclusion of part-time librarians and counselors fragments the employee group, SEIU disagreed, and PERC has determined that the bargaining unit will only include part-time faculty and part-time instructors. The bargaining unit does not include part-time librarians, part-time counselors, part-time staff or full-time employees of any employment category or contract type.
- PERC has determined that only part-time faculty and part-time instructors actively teaching for the College as of Tuesday, March 30, 2021, will be eligible to vote and determine whether SEIU will represent all part-time faculty and part-time instructors as your exclusive bargaining agent.
Per the PERC’s order, the Organizational Development and Human Resources team is now actively working to compile the list (name and contact information) of part-time faculty and part-time instructors who meet the eligibility criteria noted above. This information will be shared directly with PERC, which oversees and coordinates the election. You can expect to receive more information as soon as we know more about the election timeline and process.
In the meantime, we encourage you to educate yourself on the Service Employees International Union and on what third-party representation would, and would not, mean for you. We have compiled a comprehensive website for your reference and, of course, encourage you to go beyond what we have provided to learn more about the organization seeking to represent you.
When the election is held, we ask that you vote by returning your mail-in ballot to PERC. The decision about whether you will be represented by SEIU will be made by a majority of those who cast ballots — not the majority of those in the bargaining unit — so every vote is imperative in making the collective will of our part-time faculty and part-time instructors known.
Finally, please note that we continue to receive information from our colleagues (specifically part-time faculty and part-time instructors) about SEIU’s unsolicited outreach via email, phone, text messages and home visits. As I have shared previously, while we have and continue to be responsive to SEIU’s frequent requests for employee contact information, SEIU’s outreach efforts are not in any way sanctioned by Valencia College, and, as an employee, you are not required to engage or respond. We encourage you to contact our Valencia College Security team with any questions or concerns you have about SEIU’s unsolicited outreach to you and to learn about resources that may be available.
